Terms of Service

Effective July 17, 2026

Welcome to Sparkzy. These Terms of Service ("Terms") govern your access to and use of the Sparkzy mobile application and any related services (together, "Sparkzy" or the "Service"), provided by LoqzCorp ("we," "us," "our"). You must accept these Terms before creating an account or signing in, and by using Sparkzy you agree to them. If you don't agree, don't use the Service.

1. Eligibility

You must be at least 13 years old to use Sparkzy (16 in regions where local law requires a higher minimum age for online services). By using Sparkzy, you confirm that you meet this minimum age and have the authority to agree to these Terms.

2. Your account

You can sign in with email and password, with Sign in with Apple, or with Google. You are responsible for keeping your sign-in credentials secure and for everything that happens under your account. If you believe someone else has accessed your account, contact us at loqzcorp@gmail.com.

You agree to provide accurate information. Your display name is shown to other users on your profile, your comments, and on leaderboards. You may change your display name once.

3. The free service

Sparkzy is free to download and use. The free tier gives you full access to the Sparkzy experience with the following usage limits:

• Up to 10 quiz runs per quiz length per day (5-question, 10-question, and Risky 20-question — each capped independently, reset at 00:00 UTC).
• Up to 30 saved facts at a time. To save more, remove some saves first or upgrade to Sparkzy Pro.

4. Sparkzy Pro subscription

Sparkzy Pro is an optional auto-renewing subscription that removes the free-tier limits and adds extra features.

4.1 What you get with Pro

• Unlimited quizzes — no daily cap on any quiz length.
• Unlimited saved facts.
• 5 streak freezes per calendar month — if you miss exactly one day, a streak freeze is automatically consumed and your streak is preserved. Unused freezes do not roll over to the next month. Missing two or more consecutive days still breaks your streak.

4.2 Price and billing cycle

• Price: US $4.99 per month (or the equivalent in your local currency as shown by Apple's App Store or Google's Play Store at the time of purchase).
• Cycle: 30 days. Each subscription period ends at the next 00:00 UTC after the 30-day mark. Your Pro features remain available through the end of the current period even if you cancel.
• Auto-renewal: Your subscription automatically renews for the same duration and price unless you cancel at least 24 hours before the end of the current period. Renewals are billed to the payment method on file with Apple or Google.

4.3 How to cancel

You can cancel anytime, and the cancellation will take effect at the end of the current billing period. We do not cancel subscriptions for you — cancellations must be made through your platform's subscription manager:

• iOS: Settings → tap your name → Subscriptions → Sparkzy → Cancel Subscription.
• Android: Google Play app → Menu → Subscriptions → Sparkzy → Cancel subscription.

4.4 Refunds

Because purchases are processed by Apple and Google, refund requests are handled by them and are subject to their refund policies. To request a refund:

• iOS: visit reportaproblem.apple.com.
• Android: visit play.google.com/store/account/subscriptions.

We do not separately issue refunds outside of the App Store / Play Store refund process. If a refund is granted by the platform, your Pro entitlement may be revoked immediately.

4.5 Changes to the price or features

We may change the price of Sparkzy Pro or the features included with it. If we increase the price of an existing subscription, we will notify you in advance and give you the opportunity to cancel before the new price applies. We may also occasionally add, remove, or modify Pro features — material changes will be reflected in this document.

5. User content and community standards

Sparkzy lets you post comments and replies, and these are visible to other users. By posting content, you grant Sparkzy a worldwide, non-exclusive, royalty-free, transferable license to use, display, and distribute that content solely as needed to operate, promote, and improve the Service. You retain ownership of what you post.

You agree not to post content that:

• Is unlawful, defamatory, harassing, threatening, hateful, or sexually explicit
• Promotes violence, self-harm, or illegal activity
• Contains profanity, slurs, or other abusive language
• Spams the community, includes affiliate links, or impersonates another person
• Infringes anyone's intellectual property or privacy
• Contains misinformation that could cause real-world harm

5.1 How moderation works

• Automatic filtering: comments are automatically screened for profanity, slurs, and abusive language before they are posted. Comments that fail the filter are rejected.
• Flagging content: you can report any comment from within the app by tapping its ellipsis (•••) menu and selecting Report, choosing a category and optional details. Content reported by multiple users is automatically hidden from the community while we review it.
• Blocking users: you can block any user from their profile. Blocking immediately removes their comments from your view, removes any friendship between you, and prevents them from contacting you through friend requests. You can review and unblock blocked users at any time under Profile → Account → Blocked users.
• Enforcement: we act on reports of objectionable content within 24 hours by removing the offending content and ejecting the user who provided it. We may also remove content, restrict accounts, or terminate accounts at our discretion and without prior notice.

6. Acceptable use

You agree not to:

• Reverse engineer, decompile, or attempt to extract source code or assets from the app
• Access the Service through automated tools, scrapers, or bots without our written consent
• Attempt to bypass usage caps, falsify XP, manipulate badges, or otherwise tamper with progress tracking
• Use the Service to harass other users, including via friend requests, comments, or block evasion
• Probe, scan, or test the vulnerability of any system or network connected to the Service

7. Intellectual property

Sparkzy, including the app, the visual design, the brand name and marks, the fact-card backgrounds, the badge artwork, the quiz questions, and the underlying code, is owned by LoqzCorp and is protected by copyright, trademark, and other intellectual property laws. Nothing in these Terms grants you any right or license to use our trademarks or branding without our prior written permission.

Some fact content is sourced from publicly available APIs (for example the Useless Facts and API Ninjas services) and is used under those services' terms.

8. Termination

You may delete your account at any time from inside the app (Profile → Delete Account). Account deletion is immediate and permanent: your profile, comments, friends, saved facts, badges, quiz attempts, push tokens, and any active streak are removed.

We may suspend or terminate your account if you violate these Terms, misuse the Service, or pose a risk to other users.

9. Disclaimers

Sparkzy is provided "as is" and "as available." To the maximum extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the Service will be uninterrupted, error-free, or secure.

10. Limitation of liability

To the maximum extent permitted by law, in no event will Sparkzy, LoqzCorp, or our affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, goodwill, or other intangible losses, arising out of or related to your use of the Service.

For any direct damages, our total aggregate liability to you for any claim arising out of or relating to these Terms or the Service is limited to the greater of (a) the amount you paid Sparkzy in the 12 months preceding the claim, or (b) US $20.

11. Indemnification

You agree to indemnify and hold Sparkzy, LoqzCorp, and our affiliates harmless from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of your use of the Service, your user content, or your violation of these Terms.

12. Changes to these Terms

We may update these Terms from time to time. If we make a material change, we will update the "Effective" date above and, where appropriate, notify you in-app or by email. Continued use of Sparkzy after a change means you accept the updated Terms.

13. Governing law and disputes

These Terms are governed by the laws of the Republic of the Philippines, without regard to its conflict-of-laws principles. Any dispute arising out of or related to these Terms or the Service will be resolved first through good-faith informal discussion. If we cannot resolve it informally within 30 days, the dispute will be submitted to the exclusive jurisdiction of the proper courts of Cebu City, Cebu, Philippines, and you consent to the jurisdiction and venue of those courts. Nothing in this section prevents either party from seeking injunctive relief in any court of competent jurisdiction.

14. Apple App Store additional terms

If you downloaded Sparkzy from the Apple App Store, the following additional terms apply:

• These Terms are concluded between you and LoqzCorp, not Apple. Apple is not responsible for the Service or its content.
• Your license to use Sparkzy on an Apple-branded device is limited to use on devices you own or control, as permitted by the App Store Terms of Service.
• Apple has no obligation to provide maintenance or support for Sparkzy.
• If Sparkzy fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price (if any). Apple has no other warranty obligation with respect to Sparkzy.
• Apple is a third-party beneficiary of these Terms and may enforce them against you.
